No hope for Hoffman After Machine Malfunction

Gary Hoffman was playing the slot machines at the Sandia Resort and Casino on an Indian reservation in New Mexico in August 2006.

The casino claims it had offered Hoffman not only a free lunch but also the maximum jackpot from the machine he was playing ,500.

Hoffman explained that a casino employee “became quite intimidating with me, pointed his finger in my face and said, ‘You didn’t win. We’re not paying you any money. Do you understand what I’m telling you? You’re not getting any money.’”

The machine was sent for lab tests. The official technical report stated Hoffman won an “erroneous jackpot”.

“If he had gone into a bank and deposited ,000 and got back a deposit slip that said a million dollars, he doesn’t get to keep the balance,” said the casino lawyers “It doesn’t work that way. He knew it was wrong; he knew it was incorrect. That’s why he took a picture of it immediately.”

Hoffman took the matter through the casino’s internal appeals procedure but lost. Now he has decided to sue.

However, the vagaries of the US Justice system could mean that Hoffmann may never get his day in court as Native American reservations are treated like independent countries and contract disputes are not under US jurisdiction.
